1. Terms of Service
These Terms of Service (hereinafter “Terms of Service”) regulate the purchasing conditions of products marketed through the website www.le-tiare.com (hereinafter “Website”), owned by AVANGAL COSMETICS S.L. (hereinafter AVANGAL), with NIF B01814813 and address at Avenida de la Industria 43, Tres Cantos, Madrid. Registered in the Commercial Registry of Madrid in Volume 40770, folio 215, entry 1, page M-723296.
The use of the services of the Website, as well as the acquisition of any of its products, implies the User's acceptance, without reservations of any kind, of each and every one of these Terms of Service. Registration on the Website and use of the services means that your data as a User will become part of the files of AVANGAL COSMETICS, and will be processed in accordance with the provisions of our Privacy Policy, which the User expressly declares to know and accept, giving their consent.
This Website contains information about AVANGAL COSMETICS, and offers the possibility of purchasing the products made in the AVANGAL COSMETICS laboratories.
These Terms of Service, together with the Terms of Use and the Privacy Policy of the Website, are the only conditions applicable to the use of the website and the purchase of products through it and replace any other conditions, unless previously agreed in writing between AVANGAL COSMETICS and the User. Consequently, the User who accesses the Website, registers and purchases products through it, accepts and is bound by the Terms of Service, the Terms of Use and the Privacy Policy at the time the Website is accessed.
Any User who agrees to use the Website must be at least eighteen (18) years old.
2. Product information
Any photographs, graphics, icons or videos related to AVANGAL COSMETICS's products, as well as trade names, brands or distinctive signs of any kind contained on the Website, belong to AVANGAL COSMETICS and their commercial use and/or reproduction is prohibited.
AVANGAL COSMETICS reserves the right to decide, at any time, the products offered to Users through the Website. For this reason, AVANGAL COSMETICS may at any time add new products to those included on the Website as well as exclude products from sale, it being understood, unless otherwise provided, that such new products will be governed by the provisions of the Terms of Service in force at that time.
Likewise, AVANGAL COSMETICS reserves the right to stop providing access, at any time and without prior notice, to any of the products offered on the Website.
In the event that, due to circumstances of force majeure, a product is not available after the purchase has been made, AVANGAL COSMETICS will inform the User by email of the total or, where applicable, partial cancellation of the order. The partial cancellation of the order does not give the right to cancel the entire order, without prejudice to the exercise of the right of withdrawal that corresponds to the User in accordance with the provisions of these Terms of Service.
3. Product purchasing system
3.1. Age
The services provided by AVANGAL COSMETICS are available to users over 18 years of age who can fulfill legal contracts under the law. The User guarantees that he/she is at least 18 years old and that all the information he/she has registered on the Website is accurate and true. AVANGAL COSMETICS may, at its discretion, deny access or use of the Website to any person or entity.
3.2. Record
Any User interested in purchasing products from our website must register as a Registered User, creating an account through a simple form prior to the purchase process or as a Guest User. In both cases, you must check the compliance box in our privacy policy.
The User name, email address and password provided to AVANGAL COSMETICS are identifying elements to access and make purchases and are personal and non-transferable. Therefore, if is your sole reponsibility to protect the password in the strictest and most absolute confidentiality, assuming any damages and/or losses of any kind arising from neglecting your responsibility, as well as any misuse which could be conducted by a third party as a consequence. In accordance with the provisions of the General Data Protection Regulation (RGPD), we inform you that the person responsible for the processing of the personal data that you provide to us through our website, by telephone, or by email is AVANGAL COSMETICS.
The User name, password and email address may be modified, in which case the modified password, User name and/or email address will lose their validity.
3.3. Purchase
To purchase of any of our products, you must add the product(s) you wish to purchase to the shopping cart. Once this process has been completed, the User must go to the shopping cart page and click “Finish”.
On the cart page a summary will be shown with the products they are going to purchase and in this same step, the User will fill in their shipping information, the payment method and any discount coupons. Finally, the User must click on the “pay” icon.
Once the purchase process has been completed, AVANGAL COSMETICS will send an email confirming receipt of the order to the email provided by the User within twenty-four (24) hours of placing the order. The order confirmation sent by AVANGAL COSMETICS will not be valid as an invoice, only as proof of purchase. When the order leaves our warehouse, the User will receive a second email indicating the delivery time of their order. The User will receive an invoice for their order once they have received it at the indicated address.
4. Product price
The prices of the products offered on the Website include all applicable taxes. The shipping costs of said products will be borne by the buyer unless stated otherwise.
AVANGAL COSMETICS may modify the prices of the products on the Website at any time without prior communication. The products will be invoiced at the price that appears registered on the Website at the time of purchase.
Prices may vary from one channel to another, and there may be, for example, differences between the web price and that of physical stores. There may be promotions that only affect one of the channels. Each channel (store) reserves the right to carry out its own promotions.
5. Payment of products
Payment of the price of the products purchased and shipping costs can be made through the AVANGAL COSMETICS Gateway using a debit or credit card (VISA, MASTERCARD and AMERICAN EXPRESS) through a virtual POS or through the Paypal system.
To proceed with the payment, the User must follow the instructions that appear on the screen depending on the payment system chosen. To use the credit card through a virtual POS, the buyer must fill out a form indicating the name of the card holder, type, expiration date and security code.
AVANGAL COSMETICS does not have access to the bank data linked to the payment methods and does not know or record this data during the payment transaction.
6. Delivery of the products
AVANGAL COSMETICS will inform the User of the order's estimated delivery as part of the purchase process. The timelines provided are an estimate and refer to business days. AVANGAL COSMETICS will deliver the products purchased by the User at the earliest within 48 hours and at the latest 30 calendar days from the date of confirmation of the order through the Website. The delivery time reported in the order is informative, and non-contractual. Delivery will be made to the address provided by the User during the purchase process.
AVANGAL COSMETICS will not be responsible for errors or damages caused in the delivery when the delivery address provided by the User does not match the delivery location desired by the User or is incorrect. Likewise, AVANGAL COSMETICS reserves the right to levy shipping fees to the user if the wrong address results in additionalshipping costs..
7. Withdrawal and return of products
(i) Right of withdrawal
The User will have a maximum period of thirty (30) days from delivery of the order to withdraw, totally or partially, from the purchase of the product, in accordance with applicable legislation. Once the indicated period has ended, AVANGAL COSMETICS will not accept returns due to withdrawal of product purchases.
In the event of withdrawing from the purchase of a product, the User must contact AVANGAL COSMETICS by sending an email toorders@le-tiare.com.
In any case, should the user withdraw from the purchase, the following requirements must be met:
- The product must be in the same condition in which it was delivered and must retain its original packaging and labelling.
- Returns to AVANGAL COSMETICS must be made using the same box or envelope used in the delivery or, failing that, in similar packaging that guarantees the return of the products in perfect condition.
- A copy of the proof of purchase and the delivery note for the products must be included inside the package, indicating the returned products and the reason for the return.
No withdrawal is possible in the cases foreseen in article 103 of Royal Legislative Decree 1/2007 of November 16, which approves the Revised Text of the General Law for the Defense of Consumers and Users. In an enumerative but not limiting manner, returns cannot be made where products are personalized or perishable, without prejudice to the above. If in doubt, the User can contact AVANGAL COSMETICS.
Orders must be returned to AVANGAL COSMETICS, Avenida de la Industria 43, 28760, Tres Cantos, Madrid. In the event that the User exercises their right to withdrawal, they will support original shippingfees.
(ii) Return of damaged or incorrect products
Without prejudice to any other rights that may apply, the User will have the right to a refund of the price of damaged or incorrect products if they do not correspond to the order placed by the User. The User will have the right to claim and an identical product and for this to be delivered in perfect condition.
In the event damaged or incorrect products are returned to AVANGAL COSMETICS, the User must follow the procedure established in section (i) above, although the User, in this case, will not bear any shipping costs of said products.
As long as the User has followed the procedure established in section (i) above and the requirements established in this section have been met, AVANGAL COSMETICS will refund the price paid for returned products which are damaged or incorrect in accordance with the provisions set out in section (iii) below.
(iii) Refund of the price of the products to the User
As long as the User has followed the procedure established in this section and the requirements established therein have been met, AVANGAL COSMETICS will refund the price paid by the User corresponding to the returned products once they have been received in the AVANGAL COSMETICS warehouses. In the event that the return is made in exercise of the User's right of withdrawal described in section (i), AVANGAL COSMETICS will not reimburse shipping costs.
The User will not have the right to a refund of the price of returned products if they are not in the same conditions in which they were delivered, or the requirements established in these Terms of Service have not been met.
Partial returns of an order will give rise to a refund of the price corresponding to the product or products actually returned.
AVANGAL COSMETICS will manage the refund through the same payment system used by the User to purchase the products, within a maximum period of thirty (30) days from the collection of the returned order and once AVANGAL COSMETICS has verified that the Products being returned meet the requirements established in sections (i) and (ii) above. The application of the price refund to the User's account will depend on their banking entity.
8. Modification of the Terms of Service
AVANGAL COSMETICS reserves the right to modify, at any time and without prior notice, the presentation and configuration of the Website, as well as the Terms of Service. These Terms of Service will always be in a visible place and freely accessible to Users. Users agree to carefully read these Terms of Service every time they access the Website store. In any case, acceptance of the Terms of Service will be a prior and essential step to contracting any product available through the Website.
9. Notifications
All communications between AVANGAL COSMETICS and the User relating to these Terms of Service or the acquisition of products through the Website will be made in writing and in accordance with the communication procedures established in these Terms of Service for each particular case.
In cases which are not expressly regulated in these Terms of Service, communications to AVANGAL COSMETICS will be made by (i) postal mail at Avenida de la Industria 43, 28760, Tres Cantos (Madrid), in writing and through a system that allows accreditation of the content and its receipt by AVANGAL COSMETICS, (ii) by phone on (+34) 91 954 59 83, (iii) or by email to info@avangal.com.
10. Integrity of the Terms of Service
These Terms of Service, the Privacy Policy and the Terms of Use constitute the express and sole will of AVANGAL COSMETICS and the User in relation to their object and invalidate and replace any other agreements or contracts, verbal or written, previously reached by the parties.
11. Partial nullity
In the event that any Clause of these Terms of Service is declared void, it will be withdrawn or replaced. In any case, said declaration of nullity will not affect the validity of the rest of the provisions contained in these Terms of Service.
12. Applicable law and jurisdiction
These Terms of Service are governed and interpreted in accordance with Spanish law.
In the event that any type of discrepancy or claim arises between the parties in relation to compliance or the content of these Terms of Service, the parties agree to submit the decision of the matter raised to the competent Courts and Tribunals according to current legislation.
